By accessing or using GetWhys ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms apply to all users of the platform, including individuals accessing the free tier and organizations with paid subscriptions.
GetWhys provides a customer research and user insights platform that helps teams analyze qualitative data, synthesize research findings, and generate insight reports. Features and functionality may change over time as we improve the platform.
You must create an account to use most features of GetWhys. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep this information up to date.
You agree to use GetWhys only for lawful purposes and in ways that do not infringe the rights of others. You may not use the platform to upload content that violates applicable privacy laws, constitutes harassment, or infringes intellectual property rights. You are responsible for ensuring you have proper consent to upload any research data containing third-party information.
You retain ownership of all research data you upload to GetWhys. By uploading data, you grant GetWhys a limited license to process that data solely to provide the services you have requested. We do not claim ownership of your research data and do not use it to train our models or share it with third parties.
Paid plans are billed monthly or annually in advance. Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time, with cancellation taking effect at the end of the current billing period. We reserve the right to change pricing with 30 days notice.
We strive to maintain high availability but do not guarantee uninterrupted access to the platform. We may perform maintenance that temporarily affects availability. For enterprise customers, specific uptime commitments are available through a separate service level agreement.
GetWhys and its technology, including the AI models, algorithms, and platform code, are the intellectual property of GetWhys. You may not copy, modify, reverse engineer, or create derivative works based on our technology.
To the maximum extent permitted by law, GetWhys shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the fees you paid to us in the 12 months preceding the claim.
These terms are governed by the laws of the State of California. Any disputes arising from these terms shall be resolved in the courts of Los Angeles County, California.
